Bicycle Accidents:

As more people commute to work or school on bicycles, and with recreational cycling increasing in popularity, legislation to protect bicyclists should be enacted. Bicycle riders are vulnerable users, and motor vehicle drivers need to know the legal rights of bicyclists. Bicycle accidents occur when motorists don’t yield to bicycles properly traveling in bicycle lanes, or choose to ignore the presence of bicyclists.

Heavy Truck Litigation:

A 2002 Freightliner truck failed to heed a construction zone and slowing traffic ahead. The truck continued traveling at highway speed and plowed into a stopped vehicle, which caused a series of rear-end collisions (domino effect). The Law Offices of James S. Rogers represented the passengers in one of those vehicles who suffered serious burns as a result of the collision and resultant post-collision fuel-fed fire. This firm brought suit against the owners of the Freightliner truck and trailer and successfully settled the passengers’ claims.

Aviation Crashes:

An airplane crash is a catastrophic event for air travelers and crew members. An airplane crash may be caused by a defective airplane design, faulty parts, or airline negligence. The Federal Aviation Agency (FAA) investigates aviation crashes and generates detailed reports, often months after the crash. Aviation litigation may involve jurisdictions issues (where to file a lawsuit) and conflict of law issues (what law will be applied).

Railroad Accidents:

A railroad company may be found liable if it fails to post proper railroad crossing or warning signs, or negligently operates a train causing the death of others.

Highway Design

Highway or road design liability may be created by an improperly posted speed limit, a lack of signage, such as pedestrian crossing markings or sharp turns, warning drivers of road hazards or unsafe road design. The government entity that contracted for the road design and constructed the highway may be held liable.
